Position Summary
The Personal Injury Litigation Paralegal supports the attorneys in managing personal injury cases after litigation becomes necessary. This position is responsible for moving cases efficiently through the litigation process, from filing the complaint through discovery, depositions, mediation, trial preparation, settlement, and closing.
This role requires a bilingual English/Spanish professional who can communicate clearly and compassionately with clients, attorneys, medical providers, court personnel, and other parties throughout the litigation process.
The Litigation Paralegal must be organized, proactive, detail-oriented, and committed to providing excellent client service. The successful candidate will maintain accurate case files, meet all court and internal deadlines, communicate regularly with clients, and ensure that attorneys are fully prepared for hearings, depositions, mediations, and trials.
Work Schedule
Monday - Friday, 8:30 AM - 5:30 PM EST, McDonough, GA, with 1-hour unpaid break (8 hours per day, 40 work hours per week)
Essential Duties and Responsibilities
Case Management
- Manage a caseload of personal injury matters in active litigation.
- Review newly transferred litigation files for completeness, liability issues, damages, insurance coverage, medical treatment, liens, and outstanding evidence.
- Maintain an accurate litigation calendar containing court deadlines, discovery deadlines, hearings, depositions, mediations, and trial dates.
- Create and update case tasks, workflows, notes, tags, and case stages in MyCase.
- Review every assigned case regularly and identify the specific action necessary to move the case forward.
- Immediately report missed deadlines, urgent issues, adverse developments, or potential case problems to the supervising attorney.
- Maintain complete, organized, and trial-ready electronic files.
Pleadings and Court Filings
- Draft complaints, answers, motions, notices, affidavits, subpoenas, proposed orders, and other litigation documents for attorney review.
- Obtain necessary information for service of process and monitor service until all defendants have been properly served.
- Electronically file pleadings and other documents in state and federal courts.
- Confirm acceptance of every filing and save file-stamped copies in MyCase.
- Calculate and calendar statutes of limitation, answer deadlines, discovery deadlines, and court-ordered deadlines.
- Maintain a complete and current pleadings index for each case.
Discovery
- Draft interrogatories, requests for production of documents, requests for admission, and notices of deposition.
- Prepare complete and accurate client discovery responses for attorney review.
- Meet with clients to collect documents and information needed to answer discovery.
- Review opposing parties’ discovery responses and identify incomplete, inconsistent, or missing information.
- Prepare deficiency letters and draft motions to compel when directed by the attorney.
- Organize medical records, bills, photographs, videos, wage-loss evidence, insurance documents, and other exhibits.
- Coordinate subpoenas for medical records, employment records, surveillance footage, 911 recordings, body-camera footage, and other evidence.
- Maintain a discovery log showing the date served, response deadline, date received, and status of each discovery request.
Depositions, Mediations, and Trial Preparation
- Schedule depositions, mediations, independent medical examinations, hearings, and attorney-client preparation meetings.
- Coordinate dates with clients, attorneys, opposing counsel, court reporters, experts, and vendors.
- Prepare deposition summaries, medical chronologies, damages summaries, exhibit lists, witness lists, and case timelines.
- Prepare deposition, mediation, hearing, and trial notebooks.
- Organize and label exhibits in accordance with court requirements.
- Assist attorneys with preparing clients and witnesses for depositions, mediation, and trial.
- Arrange court reporters, videographers, interpreters, experts, demonstrative evidence, and other litigation support.
- Attend depositions, mediations, hearings, and trials when requested.
- Maintain a trial-preparation checklist and confirm completion of all required tasks.
Client Communication
- Communicate with every assigned client at least every other week, or more frequently when required.
- Explain the litigation process, upcoming deadlines, discovery obligations, depositions, mediation, and trial preparation in plain language.
- Return client telephone calls, portal messages, and emails promptly.
- Document every client communication in MyCase.
- Add a non-billable time entry for all completed work and client communications.
- Immediately notify the attorney of client complaints, treatment concerns, credibility issues, new injuries, subsequent accidents, bankruptcy filings, criminal charges, social media concerns, or other information that may affect the case.
- Provide clients with meaningful updates even when there has been no major change in the case.
Medical Evidence and Damages
- Obtain, review, organize, and summarize medical records and bills.
- Confirm that medical records and bills are complete and correspond to the correct providers and dates of service.
- Prepare medical chronologies, treatment summaries, billing summaries, and damages calculations.
- Monitor ongoing medical treatment and communicate treatment developments to the attorney.
- Assist with obtaining narrative reports, impairment ratings, causation opinions, future-care estimates, and expert reports.
- Track medical liens, health insurance claims, Medicare or Medicaid interests, letters of protection, and outstanding balances.
- Coordinate with the settlement and reconciliation team following settlement.
Attorney Support and Communication
- Prepare concise case-status reports for the supervising attorney.
- Participate in daily and weekly case-review meetings.
- Present the current litigation stage, deadlines, outstanding discovery, client status, settlement posture, and next action for each case reviewed.
- Assist attorneys with case valuation and settlement strategy.
- Review incoming correspondence, court notices, discovery, and pleadings daily.
- Provide attorneys with sufficient advance notice of deadlines and preparation needs.
- Complete attorney assignments accurately and within the stated deadline.
Settlement and Case Closing
- Assist with preparing mediation statements, settlement packages, settlement affidavits, and settlement-related documents.
- Confirm that settlement terms are accurately documented.
- Assist with obtaining executed releases, dismissals, and other closing documents.
- Calendar settlement-payment and dismissal deadlines.
- Coordinate with the reconciliation team regarding liens, medical balances, expenses, and settlement distributions.
- Confirm that all required closing documents have been filed and saved.
- Assist with closing the case in MyCase after all litigation and settlement requirements are completed.
Performance Standards and Key Performance Indicators
The Litigation Paralegal is expected to meet the following minimum weekly performance standards, subject to adjustment based on caseload and firm needs:
- Maintain at least 32 hours of documented non-billable work in MyCase.
- Participate in required attorney-paralegal strategy meetings.
- Maintain 100% compliance with court, discovery, and internal deadlines.
- Complete at least five meaningful client updates.
- Schedule or assist with depositions as required by the active caseload.
- Prepare at least two litigation matters for depositions, hearings, mediation, or trial when applicable.
- Complete settlement affidavits and affidavits of distribution as assigned.
- Ensure vendor checks and settlement-related payments are properly processed when assigned.
- Close completed cases promptly.
- Enter a non-billable time entry for all work performed.
- Maintain accurate case stages, tasks, notes, tags, deadlines, and workflows in MyCase.
- Complete assigned tasks by the deadline or update the task with an appropriate explanation and revised date.
Performance will also be evaluated based on accuracy, organization, responsiveness, client satisfaction, deadline compliance, teamwork, productivity, and the paralegal’s ability to move cases toward resolution.
Required Qualifications
- Associate degree, bachelor’s degree, paralegal certificate, or equivalent litigation experience.
- At least three years of civil litigation or personal injury experience preferred.
- Bilingual English/Spanish is required.
- Experience drafting pleadings, discovery, subpoenas, notices, and litigation correspondence.
- Knowledge of Georgia civil procedure, court filing requirements, and litigation deadlines preferred.
- Experience with electronic court filing systems.
- Ability to review and summarize medical records and bills.
- Strong written and verbal communication skills in both English and Spanish.
- Strong organizational, proofreading, and time-management skills.
- Ability to manage multiple deadlines and priorities without sacrificing accuracy.
- Proficiency with Microsoft Office, Adobe Acrobat, case-management software, and electronic document systems.
- MyCase experience is preferred.

The Litigation Paralegal must protect all client, employee, financial, medical, and firm information. The employee must comply with all internal policies, professional-responsibility requirements, court rules, security procedures, and confidentiality obligations. The Litigation Paralegal may not provide legal advice, establish an attorney-client relationship, negotiate a final settlement without attorney authorization, or make legal decisions reserved for an attorney.
